Every AI system deployed against a consequential decision will eventually be challenged. Not maybe. Not in a worst-case scenario. Eventually. The model that screens your suppliers, flags your operational anomalies, or assesses your counterparty risk will, at some point, produce an output that a vendor, regulator, or opposing counsel decides to contest.

The enterprises that understand this are not asking “how do we prevent our AI from being challenged in court?” but instead asking “what happens when it is challenged? Can we explain it? Can we contest it? Can we prove we fixed it?”

Most organizations deploying AI today cannot answer these questions. A 2025 Gartner survey found that over 70% of IT leaders rank regulatory compliance among their top three challenges for GenAI deployment, and only 23% are very confident in their organization’s ability to manage it. And the regulatory environment is accelerating: the EU AI Act’s high-risk AI provisions take effect in August 2026, carrying penalties up to €35 million or 7% of global annual turnover for non-compliance. That gap is no longer theoretical. It is accumulating liability, decision by decision, right now.

The challenging supplier

Consider an AI supply chain qualification system. You’ve built a model to evaluate suppliers, trained on historical performance data, on-time delivery rates, defect histories, financial stability indicators. The model has real predictive value. It saves your procurement team hundreds of hours. It surfaces risks human reviewers miss.

Then it rejects a supplier. The supplier is angry, and accuses you of discrimination. Their attorney sends a discovery request: produce all documentation explaining why your AI system disqualified their client.

What do you produce?

If you’re running a closed-weights model from OpenAI, Anthropic, or any other commercial source, the honest answer is: not much. You can show what the model saw at the moment of decision. The supplier’s financial filing. Their geographic footprint. A retrieved news article about a labor dispute. That’s context attribution: what was in the model’s input window when it made the call.

What you cannot show is why the model is predisposed to weight those signals the way it does. You cannot show which historical suppliers in your training data shaped its judgment. You cannot demonstrate whether its risk assessment reflects actual performance patterns or an artifact of an unrepresentative training corpus. You cannot fix the problem, because you don’t have access to what caused it.

That is not an explainability gap. That is a liability gap. And it was created the moment you deployed a model you couldn’t fully explain.

Explainability is three problems, not one

The industry talks about AI explainability as if it’s a single capability. It isn’t. It’s three distinct problems, each operating at a different layer of the system, each requiring a different technical approach.

Context attribution asks: what in the current input drove this output? Which retrieved documents, which instructions, which prompts actually shaped this decision? This is what most explainability tools provide. It’s useful: it tells you what the model was looking at. But it only describes the inputs. It says nothing about why the model interprets what it sees the way it does.

Data attribution asks: which training examples most influenced this specific output? When the model rejected that supplier, which historical suppliers in the training corpus does this decision trace back to? This is the deepest and most operationally powerful form of attribution — and it is completely unavailable when you don’t own the model.

Model attribution asks: how does the model’s internal architecture process information to reach this conclusion? Which attention patterns, which neural circuits, which learned representations are active? This is the most faithful form of attribution, but also the least accessible, especially in closed-weight models where internal weights are unavailable.

Each method alone is insufficient. Context attribution is interpretable but tells you nothing about systemic bias. Model attribution is faithful but inaccessible in closed-weight models. Data attribution is the most actionable for remediation but requires ownership of the training corpus.

An enterprise AI system capable of genuine explainability needs all three, and it needs a way to synthesize them when they conflict. When context attribution says one thing and data attribution says another, you don’t average the signals and call it done.

Explainability without remediation is just documentation

Return to the supplier scenario. Your model rejects a vendor. Context attribution tells you the financial filing and geographic risk flag drove the decision. Useful. But the deeper question is why the model weighted geographic risk the way it did.

Data attribution answers that. It traces the rejection back to the specific training examples—the historical suppliers whose performance profiles most influenced this output. If those suppliers are all large, established companies with decade-long track records, your model didn’t learn “these are reliable suppliers.” It learned “these are the kinds of companies that look like our existing suppliers.” Every newer, smaller, or geographically diverse vendor gets evaluated against a benchmark they were structurally never positioned to meet.

Without data attribution, you’ll never find it. The model will keep making biased decisions, each one adding to your liability exposure, until a supplier contest or a regulatory audit forces the question.

With data attribution, the finding is precise and actionable. And once you’ve identified the problem, you have three concrete remediation paths.

Add guardrails: Deploy an inference-time override that intercepts similar decisions and applies a corrected response. This is the fastest path: it stops the bleeding immediately while deeper fixes run in parallel. It’s not permanent; you’re accumulating exceptions rather than fixing judgment. But it contains the immediate exposure.

Retrain the model: Add corrected examples to your existing corpus and fine-tune the model again. This addresses the decision pattern directly and produces a model whose behavior is corrected, but you’re still building on top of a foundation that contains the original biased examples. Faster than corpus correction, but less thorough.

Correct the corpus: Go upstream of the training run entirely. Audit and remove the problematic source examples before the next training run, so the bias isn’t in the foundation at all. This is the most thorough path: you’re not patching behavior on top of flawed training data, you’re eliminating the flawed training data before it shapes the model’s weights again.

Most explainability systems stop before any of these paths. They tell you what happened. They don’t give you the information you need to fix it, and they don’t support the remediation process itself. Explainability without remediation is just documentation, not improvement.
